1. General Aspects

These Terms and Conditions ("Terms and Conditions") govern the relationship between BRIAL INWOOP S.R.L., a limited liability company, located in Str. Plopilor, Bl B3, Sc C, Et 1, Ap 47, Camera 1, Neptun, Jud. Constanta, 905550 Romania ("The Company" or "We") and the people who use (the "User") the website www.BRIALJobs.com ("The Website" or "BRIALJobs.com") and / or the services offered by the Company through the Website.

Access to and use of the Website, including any page or component parts thereof, or any Service provided through the Website may be done only in accordance with these Terms and Conditions, which include the Privacy Policy and the Cookie Policy.

FOR THE USE OF THE SERVICES, WE MAY REQUIRE THE USER TO EXPRESS AGREEMENT WITH THESE TERMS AND CONDITIONS THROUGH A SPECIFIC ACTION WHICH HAS THE SIGNIFICANCE OF A NON-COMMERCIAL AGREEMENT (E.G. CHECKING THE SPECIFIC "I HAVE READ AND AGREE WITH THE TERMS AND CONDITIONS OF BRIAL Jobs" BOX).

BY CHECKING A CERTAIN BOX, THE USER:

A.  EXPRESSLY AGREES TO COMPLY WITH ALL CLAUSES IN THIS SET OF TERMS AND CONDITIONS, AND ANY OTHER TERMS AND CONDITIONS APPLICABLE TO THE SERVICES;

B.  ACKNOWLEDGES THE PERSONAL DATA PROCESSING CONDITIONS ACCORDING TO THE CONFIDENTIALITY POLICY, WHICH IS INTEGRATED IN THIS SET OF TERMS AND CONDITIONS.

In order to ensure compliance with the terms of access and use of the Services, Users must check the Terms and Conditions of use at the time of each access to the Website.

Even if you omit to review the Terms and Conditions, but use BRIALJobs.com, we shall assume that you have accepted this set of Terms and Conditions (including any updates to them).

If you disagree with the provisions in this set of Terms and Conditions (including any updates to it), please do not use or, as the case may be, stop using the Website. 

2.  BRIAL Jobs Services

The services offered by BRIALJobs.com are addressed to (i) Users,  individuals who visit the BRIAL Jobs Platform, (ii) Users who are seeking a job or internship („Candidates”) and (iii) Users, legal entities or authorized individuals who post job and internship offers or search for Candidates for certain jobs or internships („Companies”).

2.1.  Creating the User account, password and responsibilities

Users may use certain BRIAL Jobs Platform features without having a Candidate or a Company account.

In order to benefit from all BRIAL Jobs Services, Users (either Candidates or Companies) must create a BRIAL Jobs Platform account by clicking on the Sign-Up button. The account can also be made through the user account on either the Facebook or LinkedIn social media platforms, in which case BRIAL jobs Platform retrieves certain public data of the User related to their Facebook or LinkedIn accounts.

Upon completion of the user account creation process, the User will receive an email with a verification and validation link of their email address.

In order to use the Services offered by the BRIAL Jobs Platform, it is necessary to:

a.  provide true, accurate, and complete data about you by filling in the required fields of the User Account Form;

b.  update the registration data to be true, accurate, and complete at all times when the situation so requires. Understand this update within 30 days of the date the changes occurred.

In the case of Companies, BRIAL Jobs will verify the correctness of the registered tax code of the Companies of the European Union on http://ec.europa.eu/taxation_customs/vies and on the Website of the Ministry of Finance of the respective country for Companies outside the European Union. For legal entities, Companies have the obligation to provide us with real information about the name, address, e-mail, telephone, name and surname of the contact person and fiscal code. The legal entities - the Companies with active account on BRIAL Jobs have to be fiscal active (so, the Companies cannot be deleted from the Trade Registry, suspended or liquidated). This criterion does not apply to the Companies in insolvency.

Users who are based abroad must, at the time of registration on the Website, fill in the valid VAT number in the dedicated field in the user account form and send us a copy of the document attesting the registration in the state of residence.

Through the survey, BRIAL Jobs consultants may request documents about the Company's domain of activity if the contact person is empowered to represent the Company or verify the correctness of the telephone number indicated in the User Account Form.

If you provide non-conforming, inaccurate or incomplete information, BRIAL Jobs has the right to suspend or block your account and refuse all current or future attempts to use the BRIAL Jobs Platform. In case of inaccurate information or of fraud attempts from the Companies, BRIAL Jobs has the right, at any moment to terminate the contractual relationship, without any liability to the Companies in default.

BRIAL Jobs is NOT required to check in advance the material published by Users. BRIAL Jobs does not respond in any way to the information and data posted, disseminated or transmitted by its Users. If requested by a User, BRIAL Jobs may investigate and verify the allegations and decide whether the information should be removed.

2.2.  Candidates

Candidates can only create a User account if they are at least 18 years of age at the time of creation. Access to the BRIAL Jobs Platform and use of the Services is not permitted for persons under 18 years old.

BRIAL Jobs is an online recruitment platform that gives you the opportunity to create a CV or register a CV, including cover letters, in our database.

Also, as part of the Services offered at extra cost, if you ask us, we can offer you assistance through our consultants for the drafting and publication of a CV in your User account, but also advice in creating a Cover Letter. With your consent one of our consultants will be able to write and post in your User account the CV you need. You can, at any time, edit the information published. The CV will be automatically created by the BRIAL Jobs platform in English, which can be downloaded and used for any other purpose and on any other platform. As part of the Services offered extra cost, if you ask us, we can also create your CV in Romanian.

The CV uploaded on BRIAL Jobs platform, including your contact details can be made available to the Companies for recruitment.

We try to limit the access to our database only to employers, human resources companies, HR managers, HR specialists, but we do not guarantee that other third parties cannot access our database. BRIAL Jobs does not assume responsibility for the use of CVs by third parties who have accessed CVs while they are in our database.

You can deactivate your CV from our database at any time or, if you wish, delete your User account. If you disable your CV from the database or delete your user account, recruiters shall no longer have access to your data.

However, as part of the Services provided by the BRIAL Jobs Platform, Companies which have accessed the CV access facility can download or transmit the information available on the BRIAL Jobs Platform on their own storage media. In this case, even if we delete your data from our database, Companies shall still be able to access your data if they have downloaded, copied or extracted them from the BRIAL Jobs Platform database. In their capacity of Operators, Companies are independently responsible for the way they use your data accessed through the BRIAL Jobs Platform.

Certain companies that have chosen to post their recruitment offers via the BRIAL Jobs Platform may understand that it is simpler to present a misleading, incomplete, incorrect or aggressive reality oriented towards other social categories. The present rules impose fairness on the part of employers, but not all Companies understand the rules. Therefore, you should discern before using the information contained in these offers, before attending an interview, before getting hired or making an investment or any other action involving the use of funds, your own resources or those of third parties. Please contact us if you are aware of the existence of such offers.

2.2.1.  Subscriptions, payment of subscriptions, and other transactions

Access to certain Services provided to Candidates may only be allowed after a membership has been paid. All payments, including the fees applicable to these payments, can be made online by credit / debit card or, upon your request, based on the tax invoice in the bank account indicated by BRIAL Jobs at the NBR exchange rate from the date of the pro forma issuance.

The BRIAL Jobs Platform can be used by some of its business partners as the basis for selling or promoting products and services. In this situation, the contract that governs your agreement between you and the supplier of the respective products and services shall be concluded between you and that supplier of products and services and not between you and BRIAL Jobs.

In the event that you wish to cancel your membership, you have the right to request the refund of the FIRST amount paid within 7 days from the date of payment of one of the BRIAL Jobs subscriptions. If you have exceeded this deadline, you understand and agree that the payments already made are not and will not be refunded. The offer is only available to Candidates registered for the FIRST TIME on the BRIAL Jobs Platform, which correctly and fully complete the registration data, provided that there are no suspicions of system fraud. Specifically, the 7 days (in which Candidates have the right to request reimbursement of the amount paid) are received only at the first registration of a Candidate, and not at subsequent registrations of related accounts, BRIAL Jobs reserving its right to refuse to grant this offer, in case of identifying an identity with a Candidate that has already benefited from this offer.

Also, we reserve the right to refuse to publish or otherwise censure any information that is against the law or good morals, or which contain licentious language.

In this regard, you accept and agree that you will respect the rule of good faith when designing and publishing your Candidate profile. Thus, you are obliged not to publish incomplete, incorrect, incorrect or discriminatory information.

If you do not comply with these rules, you understand and agree that BRIAL Jobs has the right to restrict your access to its Services. In the case of restricting the access of the Candidates who have accessed Memberships and / or Paid Services, they will be entitled to request the refund of the part of the tariff corresponding to the restricted period.

2.3.  Companies

BRIAL Jobs provides you with password-based access to the User Account created on the BRIAL Jobs Platform. Through BRIAL Jobs, Companies can search for and select Candidates for hiring.

2.3.1.  How to publish job or internship offers on the BRIAL Jobs Platform

Ads can be displayed on the BRIAL Jobs Platform for a minimum of 30 days. Choose one of the price packages that corresponds to the number of days you want the BRIAL Jobs recruitment offer to be visible. On the same day, your job or internship offer is emailed to all Candidates who match the job profile and who are subscribed to such notifications. The job or internship profile in the offer validated for publishing (The Company has clicked the publish offer button) can no longer be modified after the offer has been displayed on the BRIAL Jobs Platform and/or has been sent to the Candidates. Job or internship offers can be published for maximum 5 cities.

2.3.2.  Subscriptions, payment of subscriptions, and other transactions

Specifically, the 7 days (in which Companies have the right to request reimbursement of the amount paid) are received only at the first registration of a company / group of companies / contact person, and not at subsequent registrations of related accounts, BRIAL Jobs reserving its right to refuse to grant this offer, in case of identifying an identity with a company that has already benefited from this offer.

Also, we reserve the right to refuse to publish or otherwise censure offers that are against the law or good morals, or which contain licentious language. For example, we will not accept offers from video-chat operators, erotic massages or similar services.

In this regard, you accept and agree that you will follow the rule of good faith when designing and publishing the recruitment offer. Thus, you undertake not to publish incomplete, incorrect or discriminatory announcements and to make the selection of the Candidates subsequently subject only to those rules presented in the recruitment notice published in compliance with the applicable law.

If you do not comply with these rules, you understand and agree that BRIAL Jobs has the right to restrict your access to its Services. In the case of restricting the access of Companies that have accessed Paid Services, they will have the right to request the refund of the part of the fee corresponding to the restricted period.

You agree and approve that any delay in payment of the amounts to BRIAL Jobs constitutes a violation of the provisions of this agreement. In the event that BRIAL Jobs reserves the right to adopt other attitudes permitted by law or contract, you agree and approve to REFUND TOTALLY TO BRIAL Jobs ALL COSTS AND EXPENSES WHICH MAY RESULT IN RECOVERY OF THIS UNPAID FEES.

For operational purposes, BRIAL Jobs can allow you to benefit from the services offered during the period between the issuance of the proforma / fiscal invoice and the actual credit of the bank account of BRIAL Jobs. Through this benefit, which allows you to post an offer on the BRIAL Jobs website before confirming a payment to BRIAL Jobs, you accept and agree that it is equivalent to entering into a contractual relationship with BRIAL Jobs, giving rise to the equivalent payment obligation to that offer.

After the expiry of the agreed deadline for the payment of a proforma invoice, as it is inscribed in the respective invoice, BRIAL Jobs is entitled to restrict the access until the payment is made. The non-payment of the term may give rise to the calculation of late penalties in the amount of 0.1% per day of delay, calculated up to the payment of the full amount.

This also has no impact on the offers that will remain active: candidates will still be able to apply to the Company's active offers, and you will have access to their CVs only after the payment has been made.

2.4.  Publication of CVs / recruitment offers through the BRIAL Jobs Platform

BRIAL Jobs is a recruitment agency, but also a communication platform between Users, who are responsible for the content published on the BRIAL Jobs Platform (CVs, Recruitment Offers, etc.), hereinafter referred to as "User-Submitted Content". We reserve the right (which may be exercised at our time and without prior notice), to delete, move or edit such messages or to restrict the access of some Users to one of its communication platforms. These measures may be taken as a result of non-compliance by the Users of the legal provisions or the terms and conditions of use of the BRIAL Jobs Platform.

The User is solely responsible for the Content submitted by the respective User. To do this, you must know that posting or sending messages through the BRIAL Jobs Platform is subject to the following conditions and limitations:

a. The published offers must be complete, containing all the information or conditions related to the offer. An offer corresponds to one post.

b. You may NOT publish, transmit or refer to any type of message that may contain a form unanimously recognized in society as "advertising" to various categories of goods and services.

c. You may not publish, transmit or recommend to Users any kind of unsolicited commercial message, whether or not this reference is made through the communication systems made available by BRIAL Jobs or through other means of communication, but using the data obtained through BRIAL Jobs platform.

d. You may NOT publish, transmit or refer in any way to messages that contain recommendations to buy or not to buy a particular product or service. Also, you may not publish or refer in any way to messages that contain confidential information, whether or not they are provided with the "confidential" or any other mention of this kind, or to messages that are intended to affect the price, image or market value of a product or service. You cannot publish employment announcements within MLM (Multi-Level Marketing) networks, as well as employment announcements for bank employees.

e. You may NOT publish, transmit or refer in any way to messages that contain illegal, threatening, abusive, indecent, discriminatory or in any way violate the rights of third parties or legal provisions.

f. You may NOT publish, transmit or refer in any way to messages containing viruses or any other code sequences that prove to be destructive or that may interrupt, eliminate or limit the functionality of the BRIAL Jobs Platform or any other computer systems (hardware or software).

g. You may NOT collect personally identifiable information from BRIAL Jobs users or members, except for the sole and direct purpose of accessing the Services provided by BRIAL Jobs (i.e. applying for a vacant position at a Company or contacting Candidates for the purpose of recruitment).

h. You CANNOT restrict or eliminate the access of other Users to the communication platforms made available by BRIAL Jobs.

i. You may NOT publish, transmit or refer in any way to messages whose source is hidden.

j. You may NOT publish, transmit or refer to any "pyramid game" or any other activity intended to deceive the trust of persons, as well as any similar activities in respect of which the criminal potential or the potential to deceive the trust of a User of BRIAL Jobs Services has been proven in the past.

k. You may not publish materials that contravene any other provisions of this set of Terms and Conditions, BRIAL Jobs being able to discretely remove them from the BRIAL Jobs Platform, without any explanation whatsoever.

By posting User-Submitted Content on or through the BRIAL Jobs Platform you agree that you are solely responsible and will indemnify BRIAL Jobs for any direct or indirect damages, costs or limitations profits arising from the posting, transmission or by reference to your messages the content of which violates the conditions and limitations described above.

Some Users may understand that it is simpler to violate the rules foreseen in this set of Terms and Conditions, and as a result, some of the published messages may present a misleading, incomplete, incorrect, or aggressive reality to other social categories. You should therefore discern before using the information contained in these messages to make an investment or any other action involving the use of funds or own resources or of those of other third parties. The picture presented by published messages can sometimes be different from reality.

3.  User Account Protection (Candidate or Company)

Your access to the User Account of the BRIAL Jobs Platform is protected by a password. We recommend that you do not disclose this password to anyone. BRIAL Jobs shall never ask for your account password in unsolicited messages or telephone calls. Furthermore, we recommend that you exit (i.e. log off / sign out) at the end of each session. We also recommend that you close the browser window you were working in at the end of browsing BRIAL Jobs.

These tips are intended to remove unauthorized people from accessing your personal information or your mail.

You are responsible for keeping the confidentiality of your information and password. You shall be responsible for the use of your registration, whether or not the use is done with or without your approval. You agree to inform BRIAL Jobs of any unauthorized use of your registration data in the BRIAL Jobs Platform. The Company shall not be liable for any moral or material damage caused by your failure to comply with the data security measures used to access the BRIAL Jobs Platform.

4.  Protection of intellectual property

The content and design of the BRIAL Jobs Platform (as well as any other material relating to BRIAL Jobs) sent to you by email or provided to you in any other way (such as, for example, articles, design and any other materials we will use hereinafter referred to as "BRIAL Jobs Content"), belong to BRIAL Jobs and its collaborators - - where this is expressly specified or another author is not specified - (copyright) and are protected by intellectual property law. Articles published in the sections with articles (e.g. „BLOG", etc.) may not be made by BRIAL Jobs, in this case the intellectual property rights belonging exclusively to the BRIAL Jobs collaborators who have realized them.

You may not use, reproduce or permit anyone to use or reproduce the materials without the written permission of BRIAL Jobs or its collaborators, who have an intellectual property right over the respective content section of the BRIAL Jobs Platform. Also, it is forbidden to reproduce, in any way, in whole or in part, the information contained in the CVs of the Candidates, in the recruitment offers of the Companies, without the prior written consent of BRIAL Jobs.

You may only use the content of the BRIAL Jobs Platform for your own use and that of your Company, for the purpose for which you have registered on the BRIAL Jobs Platform. Except as stated above, the content of the BRIAL Jobs Platform may not be reproduced, modified and exploited, regardless of the commercial or non-commercial purpose of this exploitation.

Actions such as those described below are not permitted unless prior written permission has been obtained from BRIAL Jobs:

a. the reproduction or storage of the content, as well as the sending of this content to any other website, server or any other means of storing the information.

b. modification, publication, transmission, as well as participation in the transfer, sale, distribution of materials made by reproduction, modification or display of the content, without the prior obtaining of a written permission from us.

c. removal of the marks that signify the copyright of BRIAL Jobs on the content.

Any use of the content of the BRIAL Jobs Platform for purposes other than those expressly permitted by this document is prohibited. Requests for use of the content for purposes other than those expressly permitted by this document may be sent to the email address: office@brialjobs.com

Also, it is forbidden to use automatic means, including scripts, robot applications, bot, spider, crawler and / or any computer applications / programs that may deceive, or simulate certain activities or statuses in the BRIAL Jobs Platform, or, in any way, exploit certain functions or vulnerabilities of the BRIAL Jobs Platform in order to obtain benefits, for itself or for other Users or third parties, regarding the use of the BRIAL Jobs Platform or access and use of any Services.

5.  Protection of personal data

The Company treats seriously the privacy of the User's personal data. The Privacy Policy and aspects of how the Company processes the personal data of Users (including representatives Companies) are described in the Privacy Policy.

It should also be noted that Companies act as personal data providers under the applicable law and as such they have a series of rights and obligations related to the personal data of Candidate Users accessed through the BRIAL Jobs Platform.

WHEN USING THE SERVICES PROVIDED THROUGH THE BRIAL Jobs PLATFORM, COMPANIES ACCEPT AND AGREE TO COMPLY WITH THE TERMS AND CONDITIONS SET OUT IN THE PERSONAL DATA PROCESSING AGREEMENT WHICH IS an INTEGRATING PART OF THE PRESENT TERMS AND CONDITIONS. WHEN CREATING A COMPANY ACCOUNT, THE TERMS AND CONDITIONS SHALL INCLUDE THE ANNEX AND THE AGREEMENT ON THE PROCESSING OF PERSONAL DATA, WHICH ARE AVAILABLE IN YOUR USER ACCOUNT.

Also, in the case of Companies located in third countries which have not been granted an adequate level of protection, they shall be able to access Candidates’ personal data only on the basis of a set of standard contractual clauses on the introduction of an alternative set of standard contractual clauses for the transfer of personal data to third countries approved by the EU Commission. The Personal Data Processing Agreement also includes a set of standard contract terms that must be accepted by such Companies before being granted access to Candidates’ data.

In the absence of Standard Contractual Clauses signed with the Companies, the transfer can only be made under other mechanisms that secure appropriate safeguards under Article 46 of the GDPR or if the transfer is required to execute a contract with the person concerned (i.e. when the Candidate applies directly to a job offer published by a Company located in a third country).

6.  Changes and Suspension of Access

BRIAL Jobs reserves the right to suspend, modify, add or delete portions of the BRIAL Jobs Platform content at any time. Also, BRIAL Jobs reserves the right to restrict user access to part or all of its content.

BRIAL Jobs may, without any other notice or formality and without needing to explain its attitude, suspend or terminate your access to the content of the BRIAL Jobs Platform or any part of it. In this regard, BRIAL Jobs may block access to, use of, or use of any of its other services, or remove and delete any material from the Services for any reason whatsoever. BRIAL Jobs may also, whenever it wishes and without providing justification, interrupt the provision of the Services, or part thereof, with or without prior notice.

In this case, the provisions of Section 2.3.2 of the Terms and Conditions shall apply, where applicable. In the case of restricting access to paid service users, they understand and agree that the only claims they can make against BRIAL Jobs are limited to requesting a refund of the part of the fee for the restricted period.

7.  Lack of warranty and disclaimer    

While at all times we strive to ensure the quality and fairness of the data published in the BRIAL Jobs Platform, we cannot guarantee in terms of the content, the correctness, completeness and actuality of the information presented in the Candidates' CVs and the recruitment offers posted by the Companies, software or products and services published under the aegis of the BRIAL Jobs Platform. To the extent that the applicable law permits, BRIAL Jobs shall not be held in any way liable for any damages directly or indirectly caused by any direct or indirect loss of (including, but not limited to: damages for loss of profits, interruption of business, or other pecuniary damage), suffered as a result of the use or interruption of the use or lack of regularity of the information and Services provided by BRIAL Jobs.

BRIAL Jobs does not guarantee the accuracy, correctness or actuality of the information or Services provided by BRIAL Jobs. Also, BRIAL Jobs does not guarantee that computer systems or programs used by BRIAL Jobs to display or transmit information on the BRIAL Jobs Platform or in any other form do not contain viruses or other destructive code sequences or other destructive properties.

To the extent that the applicable law permits, you agree to release BRIAL Jobs from liability for any court or out-of-court actions and to cover the costs and other expenses that may arise as a result of your breach of the terms of this set of Terms and conditions.

8.  Major Force

BRIAL Jobs, its affiliates or, in general, information providers to BRIAL Jobs cannot be held responsible for any delay or error in the content provided by our publications, resulting directly or indirectly from causes not dependent on the shall of BRIAL Jobs. This exemption includes, but is not limited to: errors in the BRIAL Jobs technical equipment, lack of Internet connection, lack of telephone connections, computer viruses, unauthorized access to BRIAL Jobs, operating errors, strike, etc.

9.  Miscellaneous

9.1.  Changing the terms of this agreement

THE COMPANY RESERVES ITS RIGHT TO PERIODICALLY UPDATE THIS SET OF TERMS AND CONDITIONS (e.g. TO CORRESPOND WITH THE CHANGES IN LEGISLATION OR SERVICES PROVIDED BY THE COMPANY). USERS SHALL BE NOTIFIED WITH REGARD TO THE OPERATION OF UPDATES / CHANGES IN THE SET OF TERMS AND CONDITIONS AND REQUIRED TO EXPRESS AGREEMENT WITH THE UPDATED SET OF TERMS AND CONDITIONS. REFUSAL TO ACCEPT the UPDATED set of Terms and Conditions SHALL BRING ABOUT THE TERMINATION OF THE CONTRACT WITH THE COMPANY, AND USERS SHALL NOT BE ABLE TO USE THE BRIAL Jobs PLATFORM AND / OR THE SERVICES OF THE COMPANY.

Also, some services offered by BRIAL Jobs may be subject to different terms, which shall be displayed for each such service in a visible place and can be accessed prior to using the service.

9.2.  Advertising and content provided by other parties

Parts of the content included in BRIAL Jobs may be provided by third parties with whom BRIAL Jobs has concluded content delivery contracts. In addition, BRIAL Jobs content may include ad slots where third-party ad messages shall be displayed. BRIAL Jobs is not responsible in any way for the content provided by third parties, whether it is advertising or not. Also, BRIAL Jobs is not responsible for the content of pages referenced from within.

9.3.  Notifications

Any notification to BRIAL Jobs must be sent in writing, by e-mail or by post.

Unless the User communicates any change, the notifications shall be sent to the contact data provided by the User, and the respective notifications shall be deemed received by the User.

9.4.  Applicable law and jurisdiction

            The rights and obligations of the parties under this Agreement, as well as all the legal effects of this Agreement, shall be construed and governed by the applicable Romanian law. Any dispute relating to this agreement shall be settled before the competent courts in the location of BRIAL Jobs.

This information policy (the "Policy") aims to inform you about how BRIAL Jobs (which we may also refer to as "we" or "Organization") handles the confidentiality of the data provided by you using this Website, including any data you will give us when, for example, you subscribe to our newsletter, participate in one of our promotions or purchase a product or a job.

The Organization processes a series of personal data of Users, Candidates or Companies (i.e. representatives of Companies, legal entities, or Authorized Individual Recruiters) when using the BRIALJobs.com Platform or BRIAL Jobs Services.

For this purpose, we do all the necessary diligence to verify, reasonably, that the person providing us the data is not a child, according to the terms defined above - the responsibility for any kind of information that is provided to us by circumventing these provisions is entirely to the person transmitting this data to us.

It is important to read this policy along with all notices regarding the processing & confidentiality of the data that we will provide on different occasions when we collect or process your personal data, so that you are constantly informed about why and how we use this data. The users of the BRIAL Jobs platform are of 2 types: (a) the Candidates (natural persons) and (b) the Companies (Legal Entities).

Creating the User Account

When you create a User account as a natural person, you must provide us with a series of data, such as first name, last name, email address / phone number, age etc.

In the case of legal entities, in addition to the Company’s unique identification information, you will also provide us with the data of a contact person within the company, whose data will be: last name, first name, e-mail address / phone number, age, position held within the company etc.

Data from the registered user profile

After creating a User account, as a result of your account confirmation, you will have the registered User status and access to the BRIAL Jobs platform.

You can include a number of information in your user profile as well as in the CVs that are part of your Candidate account such as your studies, professional experience, skills, photo, job preferences etc.


Other data you provide directly when using the BRIAL Jobs Platform or interacting with BRIAL Jobs

We can store the information you received from us as a result of requests sent by email or chat, or when you participate in our polls and questionnaires; Also, if you use our practice interview services, we can process your image and voice through online conferencing services implemented in the BRIAL Jobs Platform, and we can have access to your BRIAL Jobs service conversations through our Call Centre service.

Data collected or generated by us as a result of your interaction with the jobs Platform

We receive information about when and / or how you visit or otherwise BRIAL Jobs Services, including how you use the BRIAL Jobs Platform (e.g., whether you've updated your CV or not, whether or not you applied to a job).

3.  Why do we process your personal data?

In what follows we shall inform you of the purposes for which we collect and process your personal data and on the legal basis for data processing.


3.1.  Use of Services by Candidates

If you want to enjoy all the facilities offered by the BRIAL Jobs Platform, you must create a User account. The User Account allows you to access a range of dedicated Candidate Services such as creating a CV, applying to a job, viewing employment ads, contacting recruiters, receiving ads and alerts related to ads recruitment published by Companies, etc.

BRIAL Jobs Platform can also be accessed by Companies abroad, including outside the European Economic Area, to jurisdictions that have not been adequately protected. If you apply for a position published by such Companies, your data may be transferred to such jurisdiction.

We can also use a range of data you provide to optimize your job suggestions or suggestions to complete your CV. We also use the data we receive from Candidates to create Filter Facilities for Candidates on various criteria of interest to Companies.

We have a legitimate interest in improving our Services and providing suggestions / tips to the Candidates to maximize the success of our Services. At the same time, we want to provide a search service for indicators as efficiently as possible for the Companies.

3.2.  Use of Services by Companies

Legal basis: Art. 6(1)(b) GDPR – conclusion and performance of the contract and Art. 6(1)(f) GDPR – legitimate interest. Our legitimate interest is the desire to properly conduct our contractual relationships with our clients and to provide a personalized use of our Services. At the same time, we will be able to use this information to perform data and statistics on the recruitment market, trends, techniques and procedures, as well as to improve the services offered to our Customers and Users.

Also, based on legitimate interest, we use certain personal data associated with a Company to prevent any abusive fraud / misuse of the BRIAL Jobs Recruiting Platform facilities.


3.3.  Managing relationships with Users and support

We process a series of personal data for the purposes of managing relationships with BRIAL Jobs Platform Users, for example when contacting us with various questions or requests about BRIAL Jobs Platform functionality, BRIAL Jobs Platform malfunctions or errors.

Legal basis: Art. 6(1)(b) GDPR – conclusion and performance of the contract and Art. 6(1)(f) GDPR – legitimate interest, consisting of our interest in providing adequate services to all Users.

3.4.  Providing communications on the Services

Users may receive various communications from Us that relate to the provision of the Services (e.g. if the CV was viewed by a Company, saved jobs that are expiring, alerts on the need to update the CV, alerts on scheduled interviews, etc.), either automatically or according to the preferences saved by the User in the registered account).

Legal basis: Art. 6(1)(f) GDPR – legitimate interest Our legitimate interest is closely linked to the optimization and improvement of the Services offered to the Users, who can thus benefit from all the functionalities of the Services and maximize your chances of success. We consider that our legitimate interest is to not prejudice the rights and interests of the data subjects as communications are closely linked to the provision of the Services requested. At the same time, we offer users the ability to disable these communications at any time from their User account settings.

3.5. Providing commercial communications

We want to send you promotional materials, let you know about the new services offered by the Organization, launch invitations to participate in polls or to answer questionnaires and to communicate other similar information that we consider to be of interest to you, including, if you agree, by sending you promotional materials / marketing communications on the products / services of our’ partners.

We shall forward these communications if we have your agreement.

Users can always unsubscribe from these communications. For example, if you withdraw your consent for commercial communications, we shall not be able to send you our offers or you shall not be able to participate in our polls and surveys.

We may use the personal data that the Users provide or that we collect in the context of using the Services for the purpose of performing analyses and statistics on our Services, including how the BRIAL Jobs Platform works.

Legal basis: Art. 6(1)(f) GDPR – legitimate interest the analyses and statistics we make help us to better understand how we can improve our Services or the functionality of BRIAL Jobs Platform.

In the analysis and statistics, we also use cookies and other similar technologies according to the Cookies Policy. Depending on the type of cookies used and similar technologies, the legal basis is: Art. 6(1)(f) GDPR – legitimate interest for the necessary and functional cookies or Art. 6 (1) (a) GDPR - consent for cookies for analysis, tracking, marketing, retargeting and behavioural advertising.


3.8.  Connecting via Facebook or LinkedIn plugin

Users can login or create an account through the Facebook or LinkedIn plugin that allows login through their Facebook or LinkedIn account.

By using this login option, the social network can send us some additional information from your public profile, such as: first name, last name, gender, approximate age or profile picture, email address, phone number in accordance with the terms of use of the social network, which we recommend that you read carefully. If you do not approve this data transfer, we will not keep this additional information.

Please keep in mind that if you choose to connect with an approved social network, this may involve providing certain information about your activity in the respective social network. In any case, we recommend that you check the privacy settings and read the privacy policy of those social networks to know how these data are processed by the social networks.

4.  Who do we reveal the data to?

Transfer of data

Personal data may be distributed to any other organization with which we have partnerships, if we consider that this is in our legitimate interest for internal administrative purposes (i.e. data storage) or for auditing and monitoring our internal processes.

We may distribute your personal data with and / or to other organizations if they provide us with products and services, such as IT systems.

We may disclose your personal data to (i) the entities and / or persons authorized by us (from the EEA or from third countries) involved in the provision of the Services including the provision of commercial communications (such as data centre providers, service providers), payment for various payment facilities in the BRIAL Jobs Platform (i.e. EuPlatesc.ro), e-mailing platform providers such as Webmail); (ii) Organizations including, if applicable, those outside the EEA; (iii) if we have the obligation to disclose personal data for the purpose of complying with any legal obligation or decision of a judicial authority, public authority or government body; or (iv) if we are required or otherwise permitted to do so under applicable law.

Personal data is transferred to other organizations if this is necessary in a certain situation, based on a contract, under which the recipient of personal data undertakes to comply with a high standard of protection of personal data ( the transfer of personal data is based on the "standard clauses" regarding the protection of personal data, in accordance with Article 46 (2) (c) of the General Data Protection Regulation) and / or subject to the agreement of the person whose data with personal character is transferred.

Also, your personal data may be disclosed to third party cookie providers and similar technologies as described in the Cookie Policy.

Providing data to third parties

The organization may disclose personal data to third parties. The organization provides partners with only personal data it has already processed, on which technical and organizational measures for data protection have been established and the other obligations arising from the General Data Protection Regulation have been fulfilled. The partners of the Organization have access to personal data only to the extent necessary to carry out their tasks.

The organization does not, in any case, provide, for any fee, personal data to third parties.  

The categories of recipients to whom the personal data collected can be disclosed:

• the contractual partners of the Organization (as is the case with the companies we are in partnership with, but only on the basis of a confidentiality commitment from them, which guarantees that these data are kept safe and that the provision of this personal information is done in accordance with the legislation in force);

• service providers that provide the Organization with services related to placing personal data on the common servers of the Organization, managing applications for loyalty programs, ensuring payment for purchases from the Organization and evaluating marketing inquiries (e.g.: marketing services, payment services / banking or other services), including entities that assist the Organization in the processing of data as authorized persons, insurers, etc.); The personal data of the employees of the Organization is provided to the external Accounting Firm, which compiles the accounting, fiscal and payroll records of the Organization;

• to the competent authorities (Prosecutor's Office, Police, courts and other authorities), based on and within the limits of the legal provisions and as a result of specific requests made, as well as when they are required in accordance with the applicable law;

• to other organizations in the same group or partnership with the Organization, its subsidiaries, and affiliated organizations for the purpose of management and analysis, decision making, and other business purposes. For example, we may share your information with affiliates and affiliated organizations to administer process contests, orders and requests and to expand and promote our product and service offerings,

• in isolated cases, to organizations that provide BRIAL Jobs with services that allow the employees of the Organization to report cases of violation of legal regulations or cases in which the Organization, its partners or other employees adopt an unethical approach,

• specialists, lawyers, accountants and other professional service providers.


We may also transmit personal data to third parties:

• if you ask or give us your consent in this regard;

• persons who can prove that they have the legal authority to act on your behalf;

• if it is our legitimate interest to do so in order to manage, expand or develop the commercial activity;

• if we have an obligation to disclose your personal data in order to comply with a legal obligation, any legal request from government or executive authorities, and as may become necessary to meet certain national security or law enforcement requirements, or to prevent certain illegal activities;

• to respond to any claims, to protect our rights or that of a third party, to protect the safety of any person or to prevent any illegal activity; or

• to protect the rights, properties or safety of the Organization, its employees, its customers, suppliers or other persons. Some of these recipients (including our affiliates) may use your data in countries outside the European Economic Area.

5.  How long do we keep the data?

We keep your personal data as necessary to fulfil the purposes for which they were collected, in compliance with the internal data retention procedures, including the applicable archiving rules.

The data of both Candidates and Companies (authorized natural persons and representatives of the legal persons) will be kept for the entire duration of the contractual relations with the Companies plus for the entire period provided by law for the activity of archiving and keeping the financial-accounting documents.

The data related to cookies and similar technologies are kept according to the specific terms set for the respective technologies, the storage term can be between the duration of the browsing session (for session cookies) and a duration of up to 2 years (for analysis cookies).

6. Security of your data

We understand how important the security of personal data is, and we take the necessary measures to protect our clients and others whose data we process, from unauthorized access to personal data, as well as from unauthorized modification, disclosure or destruction of the data we process in our current activity.

We have implemented the following technical and organizational measures for personal data security:

Dedicated policies: We constantly adopt and review internal practices and policies for the processing of personal data (including physical and electronic security measures), in order to protect our systems from any unauthorized access or other possible threats to their security. These policies are subject to constant verification to ensure that we comply with legal requirements and that the systems are functioning properly.

Data minimization: We make sure that your personal data that we process are limited to those necessary, appropriate and relevant for the purposes stated in this Note.

Restricting access to data: We try to restrict as much access as possible to the personal data we process to the minimum required: employees, partners and others who need to access this data in order to process and perform a service. Our partners and collaborators are subject to strict confidentiality obligations (either by contract or by law).

Specific technical measures: We use technologies that ensure the security of our customers, always trying to implement the best solutions for data protection. We also perform regular data backups in order to recover them in case of an incident and we have implemented regular audit procedures regarding the security of the used equipment. However, no website, no application and no internet connection are completely secure and untouchable.

Ensuring the accuracy of your data: Sometimes we may ask you to confirm the accuracy or timeliness of your data to be sure that they reflect reality.

Staff training: We constantly train and test our employees and collaborators on the legislation and best practices in the field of personal data processing.

Data anonymization: Wherever we can, we try as much as possible to anonymize / pseudo-anonymize the personal data we process, so that we can no longer identify the persons to whom they refer.

The right to data   portabilityYou may request that   we transmit your personal data concerning you and which you have provided to   us in a structured, commonly used and automatically readable format and you   have the right to transmit this data to another operator, in the following   cases:
• processing is based   on consent;
• processing is   carried out by automatic means.
Right to oppositionYou   have the right to object to the processing when:
•   processing is necessary to fulfil a task that serves a public interest,
•   processing is necessary for the purposes of the legitimate interests pursued   by us or a third party, including the creation of profiles based on those   provisions.
In   such case, we will no longer process your personal data, unless we   demonstrate that we have legitimate and compelling reasons that justify   processing and prevail over your interests, rights and freedoms or that the   purpose is to find, exercise or defend a right in instance.
The right to oppose   an automated individual decision-making process, including creation of   profilesYou have the right   not to be the subject of a decision based solely on automatic processing,   including the creation of profiles, which produce legal effects that affect   you to a significant extent.
These rights have   certain limitations, namely:
·the automatic decision is necessary for the   conclusion or execution of a contract between you and us;
·the decision is authorized according to the legal   norms;
·we have your explicit consent in this regard.
In such case, you can   send us a request for your personal data to be subjected to a manual   processing process.
Right of withdrawal   of consentWhen processing has   been based on your consent and there is no other basis for processing. Please   note that withdrawal of consent does not affect the processing that took   place up to that time.

  • You can withdraw your consent for direct marketing at any time by following the unsubscribe instructions from each email or other electronic message.
  • If you wish to exercise your rights, you can do so by sending a written, signed and dated request to the email address: gdpr@brialjobs.com, from the User account or by any other way that the Organization puts you at provision and is highlighted in this Policy.
  • The rights listed above are not absolute. There are exceptions, which is why each request received will be analysed so that we decide whether it is well founded or not. To the extent that the claim is well founded, we will facilitate the exercise of your rights. If the request is unfounded, we will reject it, but we will inform you of the reasons for the refusal and the rights to file a complaint with the Supervisory Authority and to bring you justice.
  • we will try to respond to the request within 30 days. However, the deadline can be extended depending on different aspects, such as the complexity of the request, the large number of requests received or the inability to identify you in a timely manner.
  • it is possible that in some cases we may have to charge a certain fee for exercising the rights, especially when we consider that this is unjustified. In this case, we will inform you within the legal term of the necessity of paying the tax and we will proceed to the settlement of the request only after this tax has been paid.
  • In some cases, we may not be able to provide the requested information because it would involve "mixed data", that is, personal data belonging to other persons and which we cannot reasonably and effectively confidential. In such a case we will inform you within the legal term, including the fact that you will be able to file a complaint with the competent authority.
  • if, although we make every effort, we are unable to identify you, and you do not provide us with additional information to successfully identify you, we are not obligated to comply with the request.

8. Complaints

If you would like your personal data to be accessed, updated, rectified or deleted in certain circumstances (for example, when personal data is no longer required for the purposes mentioned above), if you wish to request restriction of data processing in certain circumstances (e.g. , when you dispute the accuracy of the data - for a period that would allow us to verify the accuracy of the data in question); if you wish to file a complaint with us, if you wish to oppose data processing and at any time wish to withdraw your consent for the processing of your personal data you have previously granted, you may notify us at any time by means of a written, dated and signed request to the following address: Str.
